Domestic Abuse
Domestic abuse includes physical, emotional, sexual and financial abuse. Our lawyers are specially trained in this area and can act for you on an emergency basis to obtain orders to protect your safety. We can advise you of your rights. We can help to make sure that you and your children are safe and secure.
What can be done?
The police can be alerted and a number of measures put into place. The Protection from Harassment Act 1997 is designed to ensure that the police give you support. We can advise you about how this works. If this is not sufficient there are other steps that we can take.
We can obtain an Order from the Court to protect you from any more violence. Often you are entitled to public funding for this; we may be able to secure funding within hours where an urgent application to the court is necessary.
We can apply to the court for one of the following:
A Non-Molestation Order - this is an order which prevents violence or threats or threats of violence and harassment (for example sending abusive text messages or repeated telephone calls, or in fact anything which repeatedly causes you distress). When this Order is made it carries a power of arrest.
An Occupation Order - this is an order which excludes a violent party from your home and sometimes the immediate surrounding area or other designated place.
We act quickly and when necessary we will apply to the Court on the day you tell us about the abuse.
